These terms govern your use of the AiryAds platform, operated by OÜ Airyads, registry code 17567076, Harju maakond, Tallinn, Kesklinna linnaosa, Tartu mnt 67/1-13b, 10115, Estonia (“AiryAds”, “we”, “us”). By creating an account you accept them. If you do not accept them, do not use the service.

1. The service

AiryAds is a platform for creating, launching and analysing advertising campaigns across connected advertising networks and channels. Features, limits and pricing depend on the plan you select and may change as the product evolves.

2. Your account

You must be at least 18 years old and able to enter into a binding contract. You are responsible for the accuracy of the information you provide, for keeping your credentials secret, and for everything that happens under your account. Tell us immediately at [email protected] if you suspect unauthorised access.

3. Plans, payment and refunds

• Subscription fees are charged in advance for the billing period you choose. Prices are shown before you confirm the purchase.
• Advertising spend is drawn from your wallet balance. Top-ups are non-transferable between accounts.
• Unused wallet balance is refundable on request, less any amount already committed to running campaigns and less non-refundable payment-processing fees.
• Subscription fees for a period already started are not refundable, except where the law requires otherwise.
• If a payment fails, we may suspend campaign delivery until the balance is settled.

4. Your content and campaigns

You keep all rights in the creatives, text, logos and data you upload. You grant AiryAds a non-exclusive licence to host, reproduce and transmit that material to the advertising networks you target, for as long as needed to run your campaigns.

You warrant that you hold the rights to everything you upload, and that your advertising complies with applicable law and with the policies of the networks it runs on.

5. Acceptable use

You may not use AiryAds to advertise or distribute:

• content that is illegal in the jurisdictions you target;
• malware, phishing, or deceptive download prompts;
• weapons, illegal drugs, or counterfeit goods;
• content that infringes another party’s intellectual property;
• content that harasses, defames, or incites violence or hatred against people or groups.

You may not attempt to circumvent rate limits, probe or breach our security, generate fraudulent impressions or clicks, resell access to the platform without our written agreement, or use automated means to extract data beyond the documented API.

6. Suspension and termination

You may close your account at any time from the Ads Manager. We may suspend or terminate an account that breaches these terms, that exposes us or our partners to legal risk, or that fails to pay. Where the breach is remediable we will normally give notice and a chance to fix it first. On termination we stop delivery, settle any refundable balance, and delete your data per our privacy policy.

7. Availability

We work to keep AiryAds available and correct, but we provide it “as is”. We do not warrant uninterrupted delivery, particular campaign performance, or that the advertising networks we connect to will behave as expected. Planned maintenance will be announced in advance where practical.

8. Liability

To the fullest extent permitted by law, AiryAds is not liable for indirect or consequential loss, lost profit, lost revenue, or lost data. Our total liability arising out of or relating to these terms is limited to the amount you paid us in the three months preceding the event giving rise to the claim. Nothing here excludes liability that cannot be excluded by law.

9. Third parties

Advertising networks, payment providers and messaging platforms connected through AiryAds have their own terms. Your use of them is subject to those terms, and we are not responsible for their acts or omissions.

The consultant in the Ads Manager runs on a model of an outside provider. When you ask it a question, we send that provider the text of your question, the earlier messages of the same conversation, and the state of your account: your name, company, country, currency, plan with its limits, wallet balance, the names of your connected advertising cabinets, how many campaigns you hold in each state, and, if the conversation is bound to a campaign, its settings and figures. We do not send your e-mail address, your telephone number, your payment details, or the access tokens of your advertising cabinets. Using the consultant is your consent to this; do not use it if you do not agree.

10. Changes

We may amend these terms. Material changes take effect no earlier than 14 days after we announce them by e-mail or in the Ads Manager. Continuing to use the service after that date means you accept the amended terms.

11. Governing law

These terms are governed by the law of Ukraine. Disputes that cannot be resolved in good faith go to the competent courts of Ukraine, without prejudice to any mandatory consumer protections available to you where you live.
